Fiscal partners or not in 2012? My husband did not live in the Netherlands the whole year.

I would like to know if we (my husband and myself) can be fiscal partners for the whole year 2012, knowing that:
my husband moved to the Netherlands only on January 20th 2012 (so he was not living the whole year in the netherlands - he was living in belgium before, so 3 weeks in 2012);
he still works in Belgium now - lives in Terneuzen since January 20th 2012.
I heard that because he did not live in the Netherlands the whole year we cannot be fiscal partner, but we are married ! (he did not live in the Netherlands, only 20 days in 2012). Can you tell us if we can or not be fiscal partner for 2012? Because i am confused, we are married, but he was not living in the netherlands during 20 days in january
