Change a job within 3 month after losing the 30% ruling


I have the 30% ruling at the moment (April 2013) with my current job but I do not meet the current salary requirement for the ruling. Soon my 5 years in Holland will be finished (transitional period of 5 years since the 30% ruling was granted before 1 January 2012) and I will probably lose the 30% benefit since I don‘t see getting a pay hike before that. However, I have an offer from another company where I will meet the required salary standards for the 30% ruling. Now if I join that new company within the 3 months of losing my 30% benefit from the previous company, can I get the benefit again or not ?


Your question relates to the option to "transfer" the 30% ruling to a new employer with which you signed an employment contact within 3 months after the contract with your ex-/current employer ends. It is indeed possible to do this if the 30% ruling was applicable till the end date of the previous contract.

If you lost the 30% ruling it is no longer possible to have it transfered to a new employer. So if you want to change employer knowing that you will meet the salary requirement with your new employer I believe it is best to do this before the 5 years period ends and you lose the ruling because you do not meet the salary requirement with your current employer.

You may want to discuss your situation with your current employer first, to find out if they are willing to cooperate to find a solution.
