30% ruling applied to a flex bv company


Question:

I need to set up a Dutch company urgently. I am a one man IT consultant. However, I would like to still take advantage of the 30% ruling. Can you please advise on the best process, could a flex BV be the right solution?

Answer:

Expatax can also arrange the 30% ruling application, see  www.expatax.nl/30ruling.php .  You will get an employment contract with your company. The salary must meet the minimum required salary. So you will have to generate sufficient turnover. The employment contract must be handed over to the tax authorities when the application for the 30% ruling is filed.

For the 30% ruling you must be an incoming employee. This means that if you are not in the Netherlands yet, the company must be set up before your arrival. Or if you already had the 30% ruling, the gap between your last official workday at your previous employer and the startdate of the contract with your own company must not be longer than 3 months.

Be also aware that the tax authorities may look at your situation closely and check the number of clients and the independency from your client(s).
